Independent Investigation

According to Act 86 – Police Act– an independent investigation may be initiated at the request of the Ministry of Public Security when there is a serious event where someone dies or has injuries that may result in death following a police intervention or during the person's detention by a police organization.

The police investigation is conducted by a police organization that is different from the one involved in the event in order to avoid having the police lead an investigation on the activities of its own members.

The independent investigation deals with all of the facts surrounding an event, in order to establish if the evidence suggests that a criminal act was committed by the police officers involved. Following this investigation, as with all other police investigations, an investigation report is produced.

The Service de police de la Ville de Montréal (SPVM) has the required experience and expertise to conduct such investigations.
